Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pyrovex websites, applications, APIs, AI tools, billing, support, and related services (the "Services"). The Pyrovex contracting entity is the operator shown in your checkout flow, invoice, order form, or account records. By using the Services, you agree to these Terms.

Eligibility and Authority

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a company or other organization, you represent that you are authorized to bind that organization, and "you" includes that organization.

Account and Access

You are responsible for your account credentials, API keys, connected services, and all activity that occurs under your account. You must provide accurate information and keep it up to date. You may not share accounts, sell access, or allow unauthorized use of your account or API keys.

Acceptable Use

You agree not to misuse the Services, attempt to gain unauthorized access, interfere with service availability, bypass limits or safety systems, reverse engineer the Services, scrape or extract models or system behavior, benchmark the Services in a misleading way, resell the Services without permission, or use the Services for unlawful activities.

We may apply rate limits, credit limits, safety filters, moderation, and other technical protections. We may change these protections, models, features, prices, limits, or availability at any time, with notice where required by law.

Content You Submit

You retain ownership of content, images, prompts, masks, product information, and other materials you submit to the Services ("Input") and are responsible for ensuring you have all rights, licenses, consents, permissions, and legal bases needed to submit and process that Input.

You grant Pyrovex a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, modify, and create outputs from your Input solely to provide the requested Services, secure, debug, maintain, and support the Services, enforce these Terms, and comply with law. We do not use customer content to train AI models or build generalized datasets without consent. Our use of Input is also governed by our Privacy Policy.

Generated Outputs

Subject to these Terms and applicable law, you may use generated images, text, videos, edits, analysis, and other results returned by the Services ("Output") for your business or personal purposes. To the extent Pyrovex has rights in an Output, we assign or license those rights to you. Pyrovex retains all rights in its software, platform, models, prompts, workflows, templates, documentation, and underlying technology.

AI-generated Output may not be unique, and similar or identical output may be generated for other users. Output may not be eligible for copyright protection in all jurisdictions, and Pyrovex does not guarantee exclusivity, registrability, or non-infringement. You are responsible for reviewing Output before publishing, selling, advertising, or relying on it.

AI Output and Commerce Responsibility

AI Output may be inaccurate, incomplete, biased, unsafe, infringing, misleading, or unsuitable for your intended use. Pyrovex does not guarantee product accuracy, SEO ranking, marketplace approval, sales results, factual correctness, legal compliance, or fitness for any particular commercial purpose.

If you use the Services for products, marketplaces, advertising, or e-commerce, you are solely responsible for truthful product claims, pricing, availability, labels, safety disclosures, regulated goods rules, tax and shipping disclosures, platform policies, consumer protection laws, intellectual property rights, privacy and publicity rights, and any human review required before publication.

Prohibited Content

You agree not to upload, submit, generate, or attempt to generate any content, image, video, Output, or prompt that:

• is illegal under any applicable law, or facilitates illegal activity;
• is child sexual abuse material (CSAM) or sexualizes, exploits, endangers, or unlawfully depicts minors in any way;
• is pornographic, sexually explicit, obscene, or non-consensual intimate imagery;
• is violent, gory, harassing, hateful, defamatory, discriminatory, or promotes self-harm, terrorism, or violence against any individual or group;
• depicts a real, identifiable person without required consent, or is intended to deceive, impersonate, defraud, or create misleading "deepfake" media;
• infringes intellectual property, privacy, publicity, confidentiality, or other rights of any third party;
• promotes counterfeit goods, unauthorized brand use, fake reviews, deceptive product listings, misleading before/after claims, or false medical, financial, legal, environmental, safety, or performance claims;
• involves regulated goods or services where the content or use would be unlawful;
• attempts to circumvent, disable, probe, or evade safety filters, rate limits, payment controls, or technical protections of the Services; or
• contains malware, phishing, credential theft, or other abusive technical content.

You are solely responsible for all Input and Output associated with your account.

Enforcement and Penalties

We may review, filter, refuse, remove, or block any Input, Output, prompt, account, API key, or request that we reasonably believe violates these Terms, law, or platform safety requirements. Violations may result, at our sole discretion and without prior notice, in refusal or cancellation of requests, deletion of content, forfeiture of credits used or held, restriction or revocation of API access, suspension or termination of your account, and denial of refunds to the extent permitted by law.

We may preserve, disclose, and report information to law enforcement, payment providers, platforms, rights holders, or other authorities where required by law or where we believe in good faith that disclosure is necessary, including mandatory reporting of suspected CSAM.

Credits, Payments, Taxes, and Refunds

Credits are used to access AI features and are subject to your selected plan, package, promotion, or purchase. Credits have no cash value, are not legal tender, and are non-transferable unless we allow otherwise. Purchased credits do not expire during active, compliant account use unless required by law or the Services are discontinued. If we discontinue a paid Service that materially affects unused purchased credits, we will provide reasonable notice and, where required by law, a refund, migration path, or comparable remedy. Promotional, trial, bonus, or free credits may be changed, limited, revoked, or expired at any time.

Prices, credit costs, model availability, and package contents may change. Taxes, currency conversion, payment processor fees, or bank fees may apply and are your responsibility. Chargebacks, payment fraud, or failed payments may result in suspension, termination, loss of credits, or recovery of amounts owed.

Refunds for unused purchased credit packages may be requested within 14 days of purchase by contacting info@pyrovex.info. Used credits, free credits, promotional credits, and accounts suspended for abuse, fraud, or Terms violations are not refundable except where required by law. Our Refund Policy may provide additional details.

Third-Party Services and Integrations

The Services may rely on or connect to third-party providers, marketplaces, media libraries, payment processors, AI model providers, storage systems, or other external services. If you connect a third-party service, you authorize Pyrovex to access and exchange information with that service as needed to provide the Services. You are responsible for complying with third-party terms. Pyrovex is not responsible for third-party outages, permissions, rejected uploads, data loss, platform decisions, or changes to third-party services.

API and Automation

If you use APIs or automated workflows, you must keep API keys confidential, follow documentation, respect rate limits, and implement reasonable security controls. You may not use automation to overload the Services, bypass billing, evade moderation, scrape data, extract models, or create competing services from Pyrovex outputs or behavior.

Intellectual Property and Feedback

The Services, including software, designs, templates, documentation, workflows, and content provided by Pyrovex, are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services except as expressly allowed by these Terms.

If you provide feedback or suggestions, you grant Pyrovex a perpetual, worldwide, royalty-free license to use them without restriction or compensation.

IP Complaints and Takedowns

If you believe content generated, hosted, or used through the Services infringes your copyright, trademark, publicity, or other rights, contact info@pyrovex.info with enough information to identify the work, the allegedly infringing material, your contact details, a statement of your rights, and any legally required declaration. We may remove or disable content and terminate repeat infringers where appropriate.

Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Pyrovex and its affiliates, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from your Input, Output, product claims, connected services, violation of these Terms, unlawful use, or infringement of third-party rights.

Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, Pyrovex disclaims all warranties, express or implied, including warranties of reliability, availability, accuracy, non-infringement, merchantability, and fitness for a particular purpose. We do not guarantee uninterrupted service, error-free results, continued model availability, or that Output will meet your requirements.

Limitation of Liability

To the maximum extent permitted by law, Pyrovex will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of revenue, loss of goodwill, loss of data, business interruption, or cost of substitute services.

To the maximum extent permitted by law, Pyrovex's total liability for any claim relating to the Services or these Terms is limited to the amounts you paid to Pyrovex for the Services giving rise to the claim during the 3 months before the event giving rise to liability, or €100 if you have not paid any amount.

Termination

We may suspend or terminate your access to the Services or your account at any time, with or without notice, including where we suspect a violation of these Terms or fraudulent, abusive, risky, or unlawful activity. Upon termination, your right to use the Services ceases immediately, and any unused credits may be forfeited to the extent permitted by law. Sections relating to content responsibility, intellectual property, enforcement, payments, disclaimers, limitation of liability, indemnity, and termination survive termination.

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice where required by law. Continued use of the Services after updated Terms become effective means you accept the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the Pyrovex contracting entity is established, unless mandatory consumer law provides otherwise. Disputes will be handled by the courts of that jurisdiction unless applicable law requires a different forum. Before filing a claim, you agree to contact us first so we can try to resolve the dispute informally.
